Parties and acceptance
These terms govern the services provided by Jorge Alberto Niño Cabal, under the Cabecera Web brand (“Cabecera Web”), to doctors, dentists, practices and clinics (“the client”). By accepting a quote in writing, the client accepts these terms together with the confirmed scope. If they differ, the scope confirmed in writing prevails.
Services
- Design, build and launch of websites for medical practices according to the quoted package and extras.
- Optional monthly care: hosting, HTTPS, monitoring, backups, deployment maintenance and monthly minutes for small edits.
- Not included unless quoted in writing: patient portals, medical records, proprietary booking systems, patient payments, legal drafting, regulatory filings, paid advertising, domain, business email or third-party subscriptions.
Quotes and scope
Estimator prices are estimates in MXN or USD depending on the selected market and exclude taxes. Scope and price are confirmed in writing before any payment. Later scope changes (new pages, redesigns, integrations or additional languages) are quoted separately before the work is done.
Payments
- 50% of the setup total, including one-time extras, to start work.
- The remaining 50% after client approval and before launch.
- Monthly care, if selected, is billed from the launch date, monthly in advance.
- Applicable taxes are added as required by law. This website does not process payments; payments are arranged and confirmed separately.
- The site is not launched or handed off for external hosting until the balance is paid.
Timelines
Published timelines are business-day estimates that start once we receive complete information, usable assets and the deposit. They depend on scope and on how quickly the client reviews and approves. Delays in information or approvals extend timelines.
Revisions and approvals
- Each package includes the stated number of revision rounds. Additional rounds are quoted as additional support.
- Before launch the client approves in writing the credentials, medical copy, image-use rights and the final version. Cabecera Web does not publish content without those approvals.
- Cabecera Web may use AI tools to draft content, only with the client's authorization; no generated content is published without human review and approval.
Client responsibilities
- Provide accurate, complete and current information, and check that approved content is correct.
- Hold the rights to logos, photos, testimonials and text they supply, and the written consent of anyone whose testimonial or image is published.
- Obtain and maintain any reviews, notices or permits that apply to their health advertising (for example, COFEPRIS in Mexico or the relevant state board in the United States).
- Provide their own privacy notice for the practice website and meet their own data-protection obligations, including those of their booking service. In the United States this may include HIPAA-related vendor agreements; Cabecera Web does not provide compliance certification.
- Never send Cabecera Web patient information, passwords or access keys.
Monthly care and support
- Includes 15, 30 or 60 minutes a month of small edits (Essential, Practice, Clinic). Minutes don't roll over.
- Routine requests are acknowledged within 2 business days. This is not 24/7 support.
- The client may cancel monthly care effective from the next billing period.
Cancellation
- If the client cancels before work starts, the deposit is refunded.
- If the client cancels after work starts, Cabecera Web keeps the portion of the deposit corresponding to work performed and delivers the work completed so far.
- If the client provides no information or response for 60 calendar days, the project may be paused; resuming may require rescheduling.
Intellectual property and licenses
- Client content (text, logos, photos and data) remains the client's. The client authorizes Cabecera Web to use it only to provide the service.
- Once the setup total is paid, the client receives the site and its content to use and host with a compatible provider.
- Third-party licenses (fonts, tools, services) are governed by their own terms. Cabecera Web's reusable components, templates and tools remain Cabecera Web's and do not become the client's exclusive property; the client receives the right to use them as part of their site.
- Cabecera Web only shows the site as an example of its work if the client separately authorizes it.
What we don't guarantee
Cabecera Web does not guarantee patients, appointments, search rankings, revenue, uninterrupted availability of third-party services, or the client's regulatory compliance. The checklists we provide are an aid and do not replace legal or regulatory advice.
Limitation of liability
To the extent permitted by law, Cabecera Web's total liability arising from the services is limited to the amount paid by the client in the 12 months before the event giving rise to it. Cabecera Web is not liable for indirect damages, lost profits, or content approved by the client. This limitation does not apply to willful misconduct or gross negligence.
Confidentiality
Both parties will keep confidential the non-public information they receive from each other and use it only for the service relationship, unless legally required to disclose it.
Governing law and jurisdiction
These terms are governed by the federal laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Tuxtla Gutiérrez, Chiapas, waiving any other venue that may apply to them.
